Riffle leads to 2nd Degree Assault Charge

Andrew Paul Wyatt,44,of Kasson was charged with one count of 2nd Degree Assault-Dangerous Weapon, on Jan. 24.
 
According to the complaint, a Dodge County Sheriff was approached by a victim at the Dodge County Sheriff’s Office, regarding an assault that had occurred at his residence between him and his son, Wyatt.
 
The Victim stated that he had returned home from grocery shopping when Wyatt started yelling at him for not purchasing any food. Wyatt became very upset, angry and would not calm down. Wyatt started to physically hit the Victim, where a small laceration was present on Victim’s cheek. Due to the Victim’s fear of Wyatt grabbing a knife or gun, he left his residence and drove to the Dodge County Sheriff’s Office to report the incident.
The deputy and sergeant responded to the Victim’s residence to make contact with Wyatt. The deputy called out for Wyatt, but received no response. Movement was heard from the stairwell doorway, wherein Wyatt appeared. Wyatt claimed that he was with the CIA and make
incoherent rambling. Deputies noted at that time, Wyatt did not have any weapons in his hands. The deputy asked Wyatt if he had any weapons, which Wyatt responded “yes”. The deputy approached Wyatt at which time Wyatt ran up the stairs away from the deputies. As deputies began to follow Wyatt, the sgt. noted Wyatt was now holding a rifle and pointing it towards the deputies, the complaint stated.
The complaint went on to state that deputies began issuing commands for Wyatt  to drop the weapon. Wyatt stated he had a 30-06. After several moments, Wyatt came down the stairwell and was placed into custody. During a search of Wyatt, a live 30- 06 round was found in his right pants pocket and a full box of 30-06 rounds in his left pocket. A 30-06 rifle with a round in the chamber was found at the top of the stairs with the safety off.
The deputy read Wyatt his Miranda Rights, and  Wyatt agreed to speak. Wyatt stated that Victim was trying to starve him and that is why he is upset. He denied physically assaulting Victim but was unable to explain how Victim had been injured.
 
Wyatt was booked in the Steele County Jail.
 
If convicted of the felony assault charge,Wyatt can face up to seven years in prison and or a fine of $14,000.
